Estate and Trusts Associate

Location: Mississauga, Ontario

Company Description
Our client is a boutique law firm that offers both solicitor-side and litigation estate services to clients.

Role Description
This is a full-time, on-site role in our client's Mississauga office for an Estate and Trusts Associate. The successful candidate will be responsible for managing estate litigation files, providing executor advisory services, power of attorney advisory, and estate and trust planning. This is both a litigation and solicitor role, exclusively focused on wills, estates, elder law, and trust law, under the supervision and mentorship of the partners.

For more seasoned candidates, senior-level positions would be considered, with opportunities to lead and mentor junior associates.

Duties include:

  • Preparing application records, affidavits, attending and preparing for motions, negotiating settlements, attending mediations, issuing demand letters.

  • Providing legal advice and counsel in areas such as:
    • Dependent's Support Claims
    • Passings of Accounts
    • Executor Disputes
    • Guardianship / Capacity Litigation
    • Will Challenges
    • Beneficiary Rights Advancement
    • Trust Litigation
    • Estate Planning, Probate Applications, Trust Administration
    • Power of Attorney and Guardianship Applications

Qualifications

  • Bachelor of Laws (LLB) or Juris Doctor (JD) degree from a recognized institution

  • Good standing with the Law Society of Ontario (LSO)

  • Experience and exposure to estates, trusts, wills, power of attorney, capacity matters

  • Experience with estate planning, probate applications, trust administration, guardianship applications, and power of attorney work is an asset

  • Excellent research, analytical, and writing skills

  • Strong negotiation, advocacy, and interpersonal skills

  • Ability to work independently and proactively to manage a busy caseload with supervision

  • Commitment to client-focused service and developing and maintaining positive and effective working relationships with clients and colleagues

  • Strong work ethic, attention to detail, and ability to prioritize competing demands and meet deadlines
