The Financial and Consumer Services Commission of New Brunswick (the Commission) is a leader in integrated financial and consumer services regulation. The Commission's mandate is to protect consumers and enhance public confidence in the financial and consumer marketplace through the provision of regulatory and educational services. With offices in both Fredericton and Saint John, it is responsible for the administration and enforcement of provincial legislation regulating mortgage brokers, payday lenders, real estate, securities, insurance, pensions, credit unions, trust and loan companies, cooperatives, unclaimed property, and a wide range of consumer legislation. The Commission is a self funded Crown corporation responsible for the administration and enforcement of financial consumer services legislation.

Senior Legal Counsel Drafting Specialist - Legal Services (Fredericton or Saint John)

We are seeking a dynamic Senior Legal Counsel Drafting Specialist to lead the research, drafting, and review of rules and related documents. This pivotal role demands a strong grasp of legal principles, legal drafting, policy analysis, and legislative processes.

In this position, you will provide essential legal support to subject matter experts in developing and amending local rules, adhering to the Commission's rule-making regulations. As the primary drafter for most Commission rules, you will also maintain the Commission's drafting manual for local rules, ensuring it is current and effective. Collaboration with various divisions will be key to tracking and reviewing existing rules.

The ideal candidate will excel in collaboration with stakeholders, including government entities and the Commission's regulated sectors, to ensure proposed rules reflect relevant policy and are clear and effective.

Your Focus

Legal Support on Rule Proposals:

  • Collaborate with subject matter experts to provide legal advice on rule-making authority and policy feasibility.
  • Assist in legal analysis, jurisdictional scans and presentations (internal) to assist with the advancement of rules.
  • Conduct legal research on issues related to proposed rules.

Rule Drafting and Publication:

  • Review and revise existing rules for clarity and coherence.
  • Draft clear, legally sound text for new and amended rules.
  • Manage the rule-making approval process, including publication and materials for Commission meetings.
  • Facilitate consultations and respond to feedback from stakeholders.

Rule Oversight and Coordination:

  • Develop and maintain the drafting manual and templates for local rules and Ministerial consent.
  • Track rule amendments and legislative changes to ensure compliance and currency.
  • Ensure rules are published on the Commission's website and explore additional research site inclusion.
  • Provide comprehensive legal research and advice on Commission rules and other regulatory areas as needed.

What you bring

  • A law degree and eligibility for membership in the Law Society of New Brunswick.
  • 7 + years of experience.
  • Legislative or rule drafting experience.
  • Ability to lead a team in drafting.
  • Ability to provide in-depth analysis of issues.
  • Knowledge and experience in financial and consumer services legislation would be an asset.
  • Excellent writing skills.
  • Bilingualism is required.
